Job Description

DEPARTMENT MARKETING STATEMENT

The Communication Innovation Marketing Outreach team has an immediate need for a Commercial Development Manager. The incumbent can expect to work within the Capital Deliver Pre-Construction team at WMATA, supporting project delivery. Conducting research, performing vendor outreach, and identifying the most appropriate methods to market our projects, while maximizing competition and expanding our vendor pool for future procurements. Additionally, the Commercial Development Manager can expect to support contract and bid document development, market research, and market outreach for the Office of Project Development and Implementation Planning (PDIP). Supporting industry-focused analysis of alternative delivery methods for capitally funded projects while ensuring policies, procedures, and standards comply with various legal safety and other FTA project management oversight.

MINIMUM QUALIFICATIONS

Education

  • Bachelor’s Degree in Law, Engineering, Construction, Contract Management, Business, or related field

  • In lieu of a Bachelor’s Degree, a high school diploma or GED and four (4) years of demonstrated experience in contract management/development experience (in addition to experience stated below) will be considered.

Experience

  • A minimum of eight (8) years of project administration experience to include at least six years in contract management/development or project development experience.

  • Demonstrated experience and ability to produce results within a team environment, to develop productive working relationships with external and internal stakeholders and to appropriately challenge or influence decisions.

  • Demonstrated experience with contract language development

Certification/Licensure

  • N/A

Preferred

  • Juris Doctor

  • Demonstrated experience in developing contract incentive language

  • Demonstrated experience with business development and/or market research/analysis

  • Demonstrated experience with contract language development on government procurements

  • Demonstrated experience in developing contract incentive language for complex alternative delivery projects

SUMMARY

The Commercial Manager supports contract and bid document development, market research, and market outreach for the Office of Project Development and Implementation Planning (PDIP). Incumbent will support industry-focused analysis of alternative delivery methods for capitally funded projects. Incumbent ensures that policies, procedures and standards comply with various legal safety and other FTA project management oversight.

ESSENTIAL FUNCTIONS

  • Supports the Director, Commercial Innovation and Market Outreach in the analysis of alternate delivery methods for use in capitally-funded projects. Reviews and proposes use of latest industry best practices for alternative delivery methods that follow latest FTA regulations/requirements.

  • Provides consulting services to support contract development, contract negotiations (as needed) and synthesizes recommendations to company leadership for decision making purposes. Supports the development of DIV-00 and DIV-01 contract language for alternative delivery procurements in accordance with latest FTA regulations/requirements. Supports source selection plan development with Procurement and Project Implementation teams.

  • Collaborates closely with General Counsel (COUN) and Procurement (PRMT) to advance commercial terms and finalize agreements with contractor. ensuring that commercial terms and contract agreements are aligned and approved by COUN and PRMT.

  • Coordinates with Department of Strategy, Planning and Program Management (SPPM) on opportunities to create mutual solutions for alternative delivery agreements that meet the needs of both the customer and the Authority and ensure that alternative delivery commercial language and incentive structures are structured to align with the Capital Delivery budget.

  • Ensures that standard offering documents are updated and contain all business requirements that are aligned with WMATA needs and that all WMATA stakeholders are aligned on contract requirements and scope of work deliverables.

  • Works with CAPD offices to ensure compliance with WMATA procurement policies while developing commercial language for procurement of all contractor and engineering services necessary to deliver capitally-funded projects.

  • Supports solicitation development activities for all alternative delivery contracts to ensure the appropriate contract vehicle is established to meet the execution requirement of the CAPD office in charge. Ensures procurement documents are developed to align with Project Delivery Method (PDM) and Project Charter recommendations.

  • Supports pre-award activities to ensure source selection plan, evaluation criteria, solicitation amendments, pre-proposal conferences, and question clarification responses are appropriate, timely, and provide value to the Authority. Ensures WMATA sets up evaluation criteria according to industry best practice and WMATA procurement requirements. Maximizes contractor and designer procurement participation by supporting market analysis/outreach as well as ensuring that all bid questions are responded to appropriately and completely.

  • Engages with Project Implementation teams and reports on contract status, contractor performance and cost effectiveness of contract to CIMO Director. Monitors and supports the resolution, as needed, of all contract performance issues. Provides monthly performance and compliance reporting to senior leadership. Supports contract compliance and reviews what commercial terms are meeting/exceeding contract effectiveness expectations, as well as, taking lessons learned from active contracts and incorporating them in future commercial term development.

  • Monitors statuses of all alternative delivery procurement initiations and follows up with PRMT and related offices to establish timely contract agreements. Supports development of all alternative delivery procurement documents and meets procurement milestones as defined by Project Charters and the Integrated Master Schedule (IMS).

  • Performs a wide range of project, program, and policy development functions including conducting research, data analysis and framing recommendations for future contractual actions. Develops detailed project and program plans in collaboration with Project Development & Delivery Strategies (PDDS) team to streamline contracting processes and improve quality of statements of work and contract terms; leads project and program implementation tracking and assess impacts and results. Maximizes value by developing incentive structures and alternative delivery methods on WMATA contracts.

  • Collaborates and builds relationships with CAPD, COUN, SPPM, PRMT, and other WMATA stakeholder offices to efficiently manage all acquisition planning and contract compliance activities and ensure all stakeholder groups are engaged to maximize value in our commercial terms, Thereby, mitigating commercial challenges downstream.

  • Designs and executes research projects to address CAPD planning, procurement, and delivery needs. Responsible for market analysis and the execution, analysis, and report out on research findings on market trends, contractors, consultants, suppliers, and vendors to help maximize competition. Conducts market outreach and develops strong working relationships and engagement with current and new contractors, consultants, suppliers, and vendors to increase competition on WMATA procurements.

  • Designs, programs, and launches in-house customer surveys; analyzes survey data; crafts discussion guides for qualitative studies, and manages ongoing internal surveys. Creates and maintains a repository of internal feedback to better support our internal stakeholders and maximize opportunities for improvement based on survey results.

  • Monitors developments and trends in the transportation industry to increase competition and reduce commercial risk for WMATA on future procurements.
